This Privacy Policy describes how FidForward, Inc. (“cloro,” “we,” or “us”), collects, processes, and discloses Personal Information through our website at https://cloro.dev (the “Site”), our cloro branded products and services, including the cloro interface, API services, and our related applications (the “Services”). Together, the Site and Services are referred to in this Privacy Policy as our “Products”.
This Privacy Policy applies to any Personal Information for which cloro determines the purposes and means of processing (sometimes referred to as acting as a “controller”). We act as a controller when we collect Personal Information for our own purposes, including through the Site. However, this Privacy Policy does not apply to Personal Information we collect or process as an employer.
This Privacy Policy does not apply to Personal Information that we collect or process on behalf of our customers, including when our Products are used. In these cases, cloro’s customers are the controllers of Personal Information collected, processed, or generated by their use of our Products, and we only process such Personal Information according to our customers’ instructions (sometimes referred to as acting as a “processor” or “service provider,” which we use interchangeably throughout this Privacy Policy).
If your Personal Information is collected or processed by a third party, such as a cloro customer, that third party may provide additional information about how that Personal Information is handled. Please review these terms, notices, or policies as relevant to you.
This Privacy Policy does not apply to any information that we collect in a manner that does not identify an individual person, including anonymous, de-identified, or aggregate information.
We encourage you to read this Privacy Policy carefully before using any of the Services. By using our Services you agree to the collection, use, and processing of Personal Information in accordance with this Privacy Policy. This Privacy Policy includes by reference all terms and conditions in our Terms of Service.
We may collect certain information that identifies you or other individuals either directly or indirectly (“Personal Information”) when you create an account, use our Products, or interact with our Site. We may collect the following types of Personal Information:

Services configuration information, including how you have configured your instance of the Services, any provider settings and API configurations, alert preferences and notification settings, regional collection preferences, and any keywords to track; and
Services usage information, including performance metrics, feature usage statistics, information about dashboard interactions and reports generated, and API usage patterns and query frequency.
In certain jurisdictions, this Personal Information may be categorized as comprising identifiers, commercial information, internet or electronic activity information, professional information, or inferences drawn from such information.
Certain Personal Information we collect may be considered “sensitive” or “special category” Personal Information under applicable data protection laws. We only collect and process sensitive Personal Information with your consent.
We collect may collect the Personal Information directly from you when you:
Create or register an account with us;

Use or interact with our Services;

We collect and process sensitive Personal Information solely for business purposes and do not use this information for advertising, marketing, or to build a profile about you.
We may disclose Personal Information to:
Service providers, who are contractually bound to process any Personal Information solely on our behalf and according to our instructions. We may use service providers in order to help administer and improve the Site or provide our Services, personalize your experience on the Site, process payments, in order to provide us with professional services including legal and financial services, and conduct analytics on our behalf;
Third party marketing partners who may provide you, on our behalf, with information relating to our Products or services that we believe you may find of interest. We may also disclose lawfully collected datasets with partners to help improve the accuracy and relevance of those datasets;
Any competent law enforcement body, regulatory, government agency, court or other third party in response to a subpoena or where we believe disclosure is necessary (i) as a matter of applicable law or regulation, (ii) to exercise, establish or defend our legal rights, or (iii) to protect your vital interests or those of any other person;

We do not “sell” or “share” Personal Information as those terms are defined in applicable data protection laws, nor do we disclose your Personal Information to third parties for their own marketing purposes.
Your Personal Information may be transferred to, and processed in, countries other than the country in which you are resident. These countries may have data protection laws that are different from the laws of your country, which, in some cases, may not be as protective. By providing us with your Personal Information, you acknowledge the transfer of certain information to the United States for storage, use, processing, maintenance, and onward transfer of such information to other entities, regardless of their location. To perform or take steps to perform a contract with you, including when you interact with us as a customer of our Services;

Securing Your Personal Information
We maintain administrative (policies, standards, and processes), physical, and technical controls designed to protect the confidentiality, integrity, and accessibility of your Personal Information, taking into account the nature of the Personal Information.
We retain Personal Information we collect from you where we have an ongoing legitimate business need to do so (for example, to provide you with a service you have requested or to comply with applicable legal, tax or accounting requirements). Right to Know. You have the right to request information about the categories of Personal Information we collect and process about you.

Opt Out of Direct Marketing, use of Personal Information for Marketing Purposes, Profiling, and Automated Decisionmaking. You have the right to opt out of receiving direct marketing communications from us and from having us process your Personal Information for our own advertising and marketing purposes. You also have the right to opt out of our processing of your Personal Information for profiling and for use in solely automated decisionmaking.

Our Products are not directed to individuals under the age of 18, and we do not knowingly collect information on the internet from anyone under 18. If we become aware that an individual under the age of 18 has provided us with personal information on the internet, we will take steps to delete such information as soon as possible.
Automatic Data Collection through Cookies and Similar Technologies
We and our service providers may use automated data collection tools such as cookies, cookieless tracking, and other related technologies to collect certain information when you use or interact with our Products. We collect Personal Information through these technologies for our customers that are logged into their cloro account, but we collect this information in a non-identifiable manner for other individuals. Where legally required, we will ask for your consent before enabling any tracking technologies that are not necessary for network communication or to provide the Products you have requested. Most browsers allow users to block cookies, but these features may not be effective for cookieless technologies and may, even when effective, impede your use of certain features within our Products.
We reserve the right to make changes to this Privacy Policy at any time. Any changes will be applicable as of the “Last Updated” date at the top of this Privacy Policy. Sometimes, we may make more significant changes to this Privacy Policy, in which case we will provide the updated version to our customers at the email address we have on file. Your continued use of our Products constitutes acceptance of the updated Privacy Policy.
